Terms of service

1. Scope

These General Terms and Conditions of Sale (GTC) apply to all services offered by Bébou Sàrl (hereinafter referred to as "Bébou"). By using Bébou's services, you agree to the following conditions without any modification and in their entirety.

 

2. Définitions

"Tenant": Party renting the Property under this contract.

"Buyer": Party purchasing the Property under this contract.

"Customer": Tenant or Buyer.

"Property": Object rented or sold as described in Article 4.

 

3. Validation

  1. You declare that you have read and accepted these general terms and conditions of sale before placing your order. The validation of your order constitutes acceptance of these General Terms and Conditions of Sale.

Unless proven otherwise, the data recorded on www.bebou.ch constitutes proof of all transactions between Bébou and its customers via the website www.bebou.ch.

The customer has the right to notify Bébou that they waive the service, without penalties and without giving any reason, within seven (7) calendar days.

For the exercise of this right, the period begins from the day following the day the customer receives the order confirmation by email.

The customer who waives the service must notify Bébou, within the 7-day period, at the customer service of Bébou located at Route de la Bourgeoisie 65, 3966 Réchy, via email: info@bebou.ch, and simultaneously return the delivered products in their original packaging with the label (for new products) and in good condition. The customer bears the direct costs incurred by the return of the Goods. Upon receipt, Bébou will refund the amount paid through the means of payment used during the order.

 

4. Object

Rental: Bébou rents to the Tenant who accepts the Property as follows:

  • a clothing box as defined by the type and description of the package chosen by the Tenant when placing the order;
  • a clothing box as defined by the subscription taken out by the tenant (box);
  • one or more "special event" clothes as defined by the type and description of the product chosen by the Tenant when placing the order;

Sale: Bébou offers for sale to the Buyer who accepts the Property as follows:

  • one or more items as defined in the type and description of the product chosen by the Buyer.

 

5. Condition of the Property

The rented Goods are second-hand clothes. Bébou undertakes to offer only selected items to guarantee a good or very good condition, sometimes close to new. Bébou cannot guarantee any potential defects inherent in the previous use of the products; the buyer acknowledges accepting the product in the condition of used, not guaranteed, as described.

The same applies to second-hand Goods sold.

Any defective Goods (for rent or sale, new or used) can be returned for exchange or refund in accordance with the procedures indicated in Articles 3 and 14.

 

6. Purpose – Assignment – Subletting

The Tenant may not assign or sublet the rented property without the express written authorization of Bébou.

 

7. Prices

The prices of products are indicated in Swiss francs, net amounts, including VAT, excluding processing and delivery fees or other indirect contributions that may be due under Swiss or foreign legislation, as well as services to be paid additionally by the Customer (unless otherwise agreed).

Bébou reserves the right to change its prices at any time, but the products will be invoiced based on the rates in effect at the time of order registration.

The rented items remain the property of Bébou.

The products and services sold on Bébou are reserved for individuals.

No discount or discount is granted outside of promotional offers or vouchers issued by Bébou.

Delivery costs are generally included in the sales price. In the case of customer-paid delivery, the costs may vary depending on the amount and weight of the order and are expressly indicated to the customer before final acceptance of the order.

 

8. Availability

Our product offers and prices are valid as long as they are visible on the website, within the limits of available stocks.

In this context, information on the availability of products is provided to you when placing your order. Errors or modifications may exceptionally exist. In the event of unavailability of a product after placing your order, we will inform you by email or mail upon receipt of information from suppliers. You will be offered an exchange with a similar product in stock. If this is not suitable for you, your order will be canceled, and you will be refunded if your card or bank account has been debited.

 

9. Payment Terms

Payment of the full basket price is made at the time of ordering. Various payment methods are available: credit card (Visa, MasterCard, Amex, Maestro), Google and Apple Pay, and Paypal.

Any payment will be processed by a secure data encryption procedure so that no information transmitted by the buyer is intercepted by third parties.

10. Order

The contract comes into effect when the customer has placed an order and when this order has been accepted electronically by Bébou.

When the customer confirms the order by clicking on the "Validate your payment" icon, it is considered that they have knowingly accepted the content and conditions of the order in question, and in particular these General Terms and Conditions of Sale, prices, characteristics, quantities, and delivery times of the items rented by the customer.

In addition, Bébou reserves the right to suspend or cancel any order and/or delivery, regardless of its nature and level of execution, in the event of non-payment or partial payment of any amount due by the customer, in the event of a payment incident, or in the event of fraud or attempted fraud related to the use of Bébou's website, including on previous orders.

 

11. Gift Card

The gift certificate is a prepayment voucher. It can be purchased directly from our online store.

The gift certificate is not nominative, so it is transferable and must therefore be treated like cash. Bébou disclaims all liability in case of loss and theft and does not replace it. A claim can only be made upon presentation of the gift certificate.

A purchased gift certificate cannot be returned or exchanged for cash. It may, at Bébou's discretion, be exchanged for another gift certificate, valid for a different product available on our online store.

 

12. Delivery

Orders are processed from Monday to Friday, excluding holidays.

The dispatch of available items is carried out by post within approximately 5 to 7 working days.

The deadlines indicated when ordering are average usual deadlines and correspond to the shipping processing time plus the transit time.

A contribution of CHF 9.70 (for orders up to CHF 80.00) may be requested once per order. We also invite you to regularly check your order tracking and contact us by email at info@bebou.ch for any questions or problems.

Bébou cannot be held responsible in any case for the consequences of a delay attributable to one of the subcontracted delivery carriers.

Bébou will be released from its obligation to deliver in the event of force majeure.

NOTE: Bébou does not deliver parcels to postal boxes and does not deliver any goods to a minor or under guardianship clientele, unless written authorisation has been obtained from the parents or guardian.

 

13. Maintenance, Damages, Loss, and Theft

The Tenant will use, maintain, and take care of the rented item.

Specifically, they should try to wash the clothes only with similar colors and at a maximum temperature of 40°C (baby) and 30°C (maternity). Rented items must be returned washed (baby and maternity) and ironed (maternity).

The Tenant will be held responsible in case of loss or theft of an item and must report it. Bébou will conduct an analysis of the circumstances, and a discussion will be initiated.

The customer's liability cannot exceed the new value of the concerned item (according to the price list below).

In the case of damages (burns, tears, stains), the customer agrees not to make repairs themselves or through a third party. Only Bébou is authorized to handle the damages.

Any damage must be reported by the customer.

Irreparable damages:

  • For rented baby items: In the context of normal wear and tear or reasonable damages, nothing happens. Stain and hole insurance is included in the box price. Bébou reserves the right to make the final decision in case of a dispute over the definition of normal wear and tear or reasonable damages.

  • For rented maternity items: Bébou reserves the right to charge, after notifying the customer of the damage, the price of the item corresponding to the new value of the object (according to the price list below).

According to the aforementioned conditions and procedure, the customer consents and authorizes Bébou to debit 100% of the amount corresponding to the new value of the item (according to the price list below) of the rented items that have become non-compliant with the rental.

 

14. Purchase of Second-hand Clothes

Bébou offers its customers the option to sell second-hand clothes in the form of lots, primarily to replenish its rental stock. These repurchases are entirely at the discretion of Bébou based on its needs. The amount of the counterpart is evaluated on a case-by-case basis, depending on the condition of the clothes, and is compensated to the customer in the form of a voucher.

 

15. Warranty and Liability

The customer is required to check the delivered goods immediately to exclude obvious material and manufacturing defects, as well as damages due to transport. Any defect or anomaly affecting the delivered goods must be reported to Bébou to allow us to remedy it.

Our delivery commitment is void in the event of failure or non-compliance with supply deadlines by our own suppliers, and to the extent that this unavailability is not attributable to Bébou. In the case of unavailability of a product, we will inform you as soon as possible.

We undertake to exchange apparently defective products according to the assumptions stipulated in Article 5 or those that do not correspond to your order (size, season, gender).

The Tenant declares and is deemed to have all the necessary information and skills for the proper and prudent use of the item. It is up to them to supplement their information if necessary.

The Tenant is the sole guardian of the item made available during the rental period; they commit to exercising effective and exclusive control over the item.

The Tenant expressly acknowledges being the guardian of the item throughout the entire contract and, if applicable, beyond, until the effective return of the item.

The Tenant undertakes to return all rented items to Bébou. For single rentals, the rental period is specified in the offer, and the return date of the rented items is mentioned with the pack (by email or in writing). Unless the customer contacts 10 days before the end of the rental period and has a subsequent discussion with Bébou, any extension of the rental period will result in a compensation to Bébou of CHF 10.00/day of delay for the baby box and CHF 15.00/day of delay for maternity packs from the 3rd working day. The customer expressly consents and authorizes Bébou to debit their credit card/invoice the due late fees.

If the delay in returning exceeds 7 working days, Bébou will send a reminder email to return the rented items. Within 3 working days from the date of sending the reminder email, if the customer has not returned the items (or provided proof of return), the customer expressly consents and authorizes Bébou to debit their credit card/invoice an amount of CHF 200.00 for baby clothes and CHF 300.00 for maternity clothes. This authorization for debit/invoicing serves as a deposit.

In case of partial non-return of rented items, Bébou will deduct or invoice an amount corresponding to the new value of the item (according to the price list, below Appendix 1) for the items not returned.

Bébou assumes no responsibility for the rented item, especially for its inappropriate, careless, or illegal use.

 

16. Voluntary Extension of the Rental Period

For single rentals, the rental period can be extended at the customer's request within a minimum of 10 days before the end of it. The rates are as follows:

  • Standard baby box: CHF 10.00 per additional week from the 3rd working day after the end of the scheduled rental period.
  • Comfort baby box: CHF 13.00 per additional week from the 3rd working day after the end of the scheduled rental period.
  • 4-piece maternity box: CHF 10.00 per additional week from the 3rd working day after the end of the scheduled rental period.
  • 6-piece maternity box: CHF 15.00 per additional week from the 3rd working day after the end of the scheduled rental period.

18. Data Protection

The information and data collected about you during the creation of your account are necessary for the management of your order and our business relationship. They may be transmitted to companies contributing to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing, and payment. This information and data are also kept for security purposes, to comply with legal and regulatory obligations, and to allow us to improve and personalize the services we offer and the information we provide to you.

You can access all your data and modify it at any time on your customer account on the www.bebou.ch website.

Based on your choices made during the creation or consultation of your account, you may receive offers from our company. If you no longer wish to receive them, you can request to opt-out at any time.

Our website is also designed to be particularly attentive to the needs of our customers. This is one reason why we use cookies. The purpose of the cookie is to track your visit to our site. Cookies are only used by Bébou to improve the personalized service intended for you.

 

19. Final Provisions

The place of performance for Bébou's services is located at the headquarters of Bébou.

Bébou reserves the right to modify these General Conditions of Sale (CGV) at any time. The modifications will be communicated on Bébou's website and will come into effect at the time of their publication.

Only Swiss law is applicable to these CGV and any disputes arising from or related to the relationship between Bébou and the Customer.

The exclusive competent court for all disputes between Bébou and the Customer is located at the headquarters of Bébou. However, Bébou is entitled to take legal action against the Customer at their place of domicile.
